The Intersection of the ADA and FMLA: An Interactive Workshop in Managing Leave

Managing employees under all the various employment laws can feel daunting. Managing employees when these employment laws intersect can feel almost impossible. In some situations, both the Family and Medical Leave Act (“FMLA”) and the Americans with Disabilities Act (“ADA”) may require an employer to provide an employee with leave. This interactive workshop will dive into the tricky situations where the ADA and FMLA intersect.

This workshop will begin by providing an overview of the FMLA and ADA’s requirements. We will then utilize interactive case studies to illustrate the problems that arise when the two Acts intersect, what pitfalls an employer should be aware of, and how to develop strategies to handle these situations. Specifically, case studies will focus on problems such as when an employee is actually entitled to leave, the interactive process, poor performance, and working from home/telecommuting.
