Have Your Policies Been Trumped? How the Current Political Climate May Impact Your Workforce

The political climate can have significant impact on how employers operate, and the past several years have shown just how far the pendulum can swing. Under the Obama administration, there were a number of employment decisions that had great impact on employers, including National Labor Relations Board (“NLRB”) activism regarding employer handbook policies and new Fair Labor Standards Act regulations raising the salary threshold to qualify for exempt status. Many of the employment decisions that were established during the Obama administration set aside policies and regulations that had been well established for decades or even longer, and left employers scrambling to make changes to keep up with the newly established policies, agency positions, and regulations.

In the past year and a half, there have been a number of significant changes to many of the employment policies that were established during the Obama administration. In the face of such turmoil, unionized and non-unionized employers alike are left wondering where things stand, and how to proceed. In this small group employment law briefing, we will discuss recent changes to federal agency policies, regulations, and other hot-button issues, and how to respond to the many changes that have occurred.

  • The NLRB’s about-face regarding:
    • Joint employer status
    • Micro-units
  • FLSA exemptions – status and updates
  • Sexual orientation and gender identity as protected classes
  • New rules governing tip pooling
