Over the last several months, the National Labor Relations Board has been on a fast track to overturn as much Trump-era employer-friendly precedent as possible.
At the end of August, the Board issued a slew of decisions, which not only reversed a number of Trump-era decisions but also overturned years of established labor law. These decisions will, among other things, make it easier for unions to gain the right to represent employees, expand the protections of the National Labor Relations Act to more employees, subject employer workplace policies to enhanced Board scrutiny, and require unionized employers to bargain over more issues than before. And, just last week, the Board continued its stride by issuing a long-anticipated rule broadening its definition of joint employer.
